Terms and Conditions of Use

By registering to participate in Texas A&M’s Performance-based Academic Coaching Team System (hereafter the PACT System) you are agreeing to the rules stated here. While ATPE believes the PACT System to be a valuable resource to its members, ATPE does not monitor or administrate any services provided on the PACT System Web site, nor does the association monitor any information on the PACT System Web site for accuracy. All users must also agree to the Terms of Use stated on the PACT System Web site before participation in the PACT community can be granted.

Service Standards
The ATPE service agreement with Texas A&M University related to use of the PACT System requires that PACT user Help Request submissions receive a substantive response within 24 hours of submission. If you, as an ATPE member and user of the PACT System, do not receive a response within 24 hours, please report your experience to prof_dev@atpe.org. You can also contact ATPE Professional Development Coordinator Kris Childers at (800) 777-ATPE (2873).

Disclaimer/Warranty
Access to the PACT System Web site does not create any future right to access or use and such access may be changed at any time, with or without notice.

Privacy
Personal information provided through the registration process will not be sold or shared except as described below (License to ATPE). By registering, you are giving ATPE permission to contact you via e-mail with ATPE membership promotions or requests for feedback.

Anyone with Internet access may view all public forum exchanges. Posted messages are not confidential. For this reason, use discretion when posting. DO NOT USE NAMES or other information that might identify you or anyone else. If you provide personal information to others via the public forum or the private message system, you do so at your own risk.

User understands that any information posted, exchanged or disseminated on the PACT System Web site is subject to the Public Information Act, Chapter 552 of the Texas Government Code.

Limitation of Liability
ATPE is not liable for any direct, indirect, special, incidental or consequential damages from the use of any PACT System services or the inability to use any PACT System services. Individual users will be held personally responsible for any defamatory, slanderous, offensive or illegal conduct associated with the use of the PACT System services.

PACT System users agree to INDEMNIFY, DEFEND AND HOLD HARMLESS ATPE, its officers, board of directors, agents, servants and employees in their individual and official capacities, and �ATPE� from any and all claims arising from participation or use of the PACT System including, without limitation, court costs, expenses and reasonable attorney’s fees.

License to ATPE
By submitting content to the PACT System public message board or any other sites on which information can be viewed by the public, you are agreeing that ATPE may reproduce, modify and distribute such content with prior written approval for any purpose. You also agree that ATPE may identify you by name or screen name as the author of your posts when ATPE deems it appropriate, with prior written approval.

Links
While there may be links to other Web sites included or offered on the PACT System Web site, ATPE is not responsible for the content of these linked sites and does not endorse the companies or the content of these linked sites.

Legal
Eligible members may contact the ATPE Member Legal Services Department for employment-related legal issues.

Holidays
PACT System e-mentors and employees will not be available during Texas A&M System holidays, listed as follows:
November 26–27, 2009—Thanksgiving
December 23, 2009–January 1, 2010—Christmas-New Year
January 18, 2010—Martin Luther King, Jr. Day
March 18–19, 2010—Spring Break
May 31, 2010—Memorial Day

Release
I agree to the term and conditions of use and release ATPE from any liability or damages arising from the use of any of the PACT System services.
